A 42 year old man Letlhogonolo Tshipe’s attemp to withdraw a case of causing grievous bodily harm was stalled today by magistrate Solomon Setshedi.
According to prosecutor Motsholathebe, the matter was coming for trial today when the complainant told court of his intention to drop the charge against the accused. However, magistrate adviced the prosecutor to seek guidance from DPP as its a serious matter given that the victim lost his ear.
He added that before withdrawing the matter, prosecutor should look at the gravity of the offence. The complainant said he is withdrawing the matter as he talked to the accused’s mother who promised to compensate him with P20 000.
Magistrate asked him if thats the cost of an ear to which he replied its for therapy and the ear will be paid at a later stage.
Setshedi adviced that alternatively complainant should file a withdrawal statement and prosecution will forward it to DPP. “My advice is that even if you proceed with this matter, if accused is convicted, you may still apply for compensation,” magistrate said.
Magistrate also asked accused Lesego Tsie why he fight to an extent of biting his opponent, he didn’t answer. In a post interview, complainant revealed that the incident happened in 2015 and was only brought to court in 2019.
He narrated that at the time,accused was dating his sister. He came from bars at night and knocked on the bedroom window of his sister. He woke up and asked him to leave and he refused. He then pushed him and he retaliated by biting off his ear flap. He took the ear flap and went to Thamaga primary hospital where it was stitched back and was referred to Princess Marina Hospital. He spent a night in Marina and was discharged. After two weeks, the ear flap got infected and it was removed. He maintains his hearing was not impaired by the incident.
