PROSECUTION GIVEN LAST CHANCE TO PROSECUTE HON TSHENYEGO

A case in which councillor Meshack Tshenyego is accused of threatening to kill Letlhakeng/Lephepe MP Liakat Kably was postponed to 14 March to give prosecution last opportunity to conclude investigations and prosecute the matter.

Prosecutor Thema Marumolo informed court that the substantive prosecutor from DPP was attending another matter at high court. However, he said she has submitted the file to director and awaiting consent to prosecute.

Magistrate Solomon Setshedi was not happy with the fact that the prosecution produced no evidence to show that the matter is at DPP and that the substantive prosecutor was appearing before the High Court. Attorney Masaka for the accused noted that the savingram from DPP is merely sending the docket back and instructing the police to carry further investigations on the matter.

Masaka informed court that the accused has been suspended from BDP as he has a pending case and could not stand for Chairmanship elections. Furthermore that the person who reported the matter is now the chairman. “We are telling the court these facts because this person has a motive and has achieved it”

He said the BDP primaries are approaching and accused cannot contest because of the suspension. Counsel further questioned the kind of investigations they are doing and warned that the police are helping whoever is trying to kill Tshenyego’s political career.

“We thought DPP is serious but now they are playing more than the police, we are of the view that the matter be dismissed.”
Marumolo opposed application to dismiss the matter.
